IN COURT - Estoppel applied to scheme trustees Print E-mail

In Catchpole v Trustees of the Alitalia Airlines Pension Scheme, the High Court has ruled that the trustees, who had wrongly advised Mr Catchpole that a spouse’s pension would be payable to his partner in the event of his death, were bound by estoppel because he acted on the basis of the trustees’ assurances by remaining unmarried. The judgment reversed a decision by the Pensions Ombudsman. (Brief details on p.14.) More details of the latest regulatory and case law developments appear on p.14. National Health Service Pension Scheme (Amendment) Regulations 2010 (SI 2010/1634): make a number of changes to the NHS Pension Scheme, including: introducing uprated pay/earnings bands for the purpose of assessing tiered contribution rates; specifying the employer’s contribution rate to be 14%; and reflecting the roles of all interested parties in respect of setting assumptions for calculating liabilities.
